Study Of Antitrust Laws To Protect Small And Medium Enterprises

It is necessary to protect the middle-small enterprises through Anti-trust Law. Comparing the deficiency of protecting of our middle-small enterprises by some terms, of Anti-trust Law with the protection of foreign middle-small enterprises by Anti-trust Law, analyzing the causes of our middle-small enterprises regulated by Anti-trust Law under the practical system, considering the insufficiency of middle-small enterprises protected by Anti-trust Law(draft) put in by legislation committee, using for reference of the lawmaking experience of other states, the article puts forward some legislation suggestion applying to out national conditions.The article emphatically analyses the causes of the middle-small enterprises regulated monopolization and the relationship between the Anti-trust Law and industry policies, as well as searches for the causes of lack of Anti-trust Law (draft) from the view of industry policies and legislation. Then, it is based on the regulations of Anti-trust Law protecting the middle-small enterprises, analyses the background of lack of Anti-trust Law and points out the frame for content of Anti-trust Law (draft). The lack of some institutions, such as compulsory schism, retaining stock, cadre pluralism, financial organizations holding stock, forbidding damage petition, supplies a developing hotbed for restricting competition.Therefore, six legislation suggestions are put forward in the article to protect the middle-small enterprises so that they can avoid invasion and damage in the play fair.
