Hearing System For Consultations Under The Democratic Perspective

The hearing system rooted the Natural Justice of western nation. It spreads to China in recent years, and rapidly obtained the development. As the typical model of consultative democracy, it has the consequence in the Chinese socialism democratic advancement.This article based on the predecessor's researches, and taken"the hearing system under view of consultative democracy"as its topic, and analyzed the developments and problems of the hearing system in our country, exploring the methods to perfect the hearing system. The article mainly from both theory and practice two stratification planes analyzed the hearing system which is under view of consultative democracy.The hearing system is the typical model of consultative democracy .This firstly manifested the principles of the hearing system :openness,validity,feasibility and effectiveness these four principle has manifested the consultative democracy value;Next, the hearing system function has manifested the intrinsic request of consultative democracy.The hearing system has obtained very big developments in domestic and foreign ,but its development in our country actually has its unique social background。In the development of our country, the hearing system has fully displayed its consultative democracy function: It has enhanced citizen's participation enthusiasm, has guaranteed the correlation decision-making public opinion foundation, moreover has balanced the benefits in every way, has stabilized the social order .But at the same time, we also had discovered some urgently the questions which need to solve: The hearing scope is narrow, the legal system is not perfect, the procedure is not standard, information is not symmetry, hearing result valid is insufficiency and so on. It seriously hindered our country democratic system consummation.At last ,we carry on the innovation and the consummation once more from the consultative democracy view to our country hearing system, and develop it to face the direction which is in favor of constructing the socialism harmonious society.
