Network Of Financial Crime

Along with the popularization and application of the network , the entire society has already entered an information society, the development of the information technology enormously changed the traditional manner of human's work , consumption and communication, which even affected the pattern of the human society。Because the application in the financial industry field comes first comparing with the other fields, the processing of the financial-service relies on the computer day by day, and the computer network attracts great financial secrets and wealth, the E-finance pattern has gradually formed. The change of the traditional financial pattern has initiated the E-finance crime. At present, the E-finance crime in China is expanding on the aspects of scales and types. Therefore, carefully studying, preventing, attacking the E-finance crime and discussing the legal norm have become an extremely important aspect in the course of preventing the E-finance crime.At first, this paper analyzed the concept and characteristic of the E-finance, and then studied the concept, crime constitution and expression of the E-finance crime with the theory of criminal law and criminology. The paper has discussed the causes of the E-finance crime from five aspects: those are the analysis of the social background, the analysis of the crime object of the E-finance crime, the analysis of the crime cost, the analysis from the aspect of the finance management and the analysis of the legal construction. The paper has offered corresponding countermeasures from the aspects of law and network. To benefit the practice and healthy development of China's E-finance industry is the paper's purpose.
