The Social Responsibility Of Companies

The problem of corporate social responsibility (CSR) is a new subject in the theory of Company's Act in our country. In the past, domestic scholars study this problem mostly from the economical view, while this article is going to introduce and discuss the CSR comprehensively through the standpoint of law. The article is composed of three parts, that are: the introduction, the main body and the conclusion, while main body includes four chapters:In the first chapter, there is a brief introduction of the CSR, foreshadowing for the further discussion as follows:firstly,by citing an article written by Cheng Siwei,the National People's Congress Standing Committee member, points out the current situation that some of the our companies are lack of social responsibility, thus leads to the theme of the article; secondly, Introduce some fundamental problems of the CSR such as origin, development, definition, content.In the second chapter, the article is intended to analyze the basic theory of the CSR. logically, discuss the theoretical basis of the CSR firstly, including its economics basic, sociology basic, law basic and the theory of value selection; secondly, analyze the limitation of the theory of CSR.In the third chapter, enumerate and compare the practice of CSR and the relative legislation in America, Britain and Germany and etc. Western countries. Furthermore, elaborate the legislation of CSR and application of its law in our country, including its development history, CSR's embodiment in the new Company's Act and the emerging problems when the Act is carried out.In the chapter forth, there's an exploration of the theory systems construction of CSR in our country. Firstly, through several actual instances presents the significant meaning in the macro aspect and the positive effect in the micro aspect. Furthermore, display some main points of the theory that problem of CSR in our country is needed to be solved and the relative legislation issues from the authors angle of view. Finally, bring up some of my personal recommendations.
