Research On The Socialized Execution Of Imprisonment

That imprisonment becomes major kind of punishment replacing life penalty and physical punishment is the improvement in crime and punishment of human thought. Nevertheless putting in closed prison for ages can easily lead to formation of criminals'prisonization personality and therefore it may reject the realization of the penalty purpose of rectificating criminals by education, repairing damaged social relations and promoting the criminals'returning society. Serving as important methods and effective means of overcoming the drawback of imprisonment, socialization of prison execution refers that prison execution should be guided by prison and we can lead social forces to actively participating in it. By means of imitating how in society to organize criminals'life, labor and learning activities in prison, we can reduce criminals' personal dangerousness and recidivism possibility, repair damaged social relations because of their crimes and then promote criminals' reinstatement of the society smoothly. The thought of socialization of prison execution originates from criminal classical school and by the last century it has achieved the transformation from idea to practice through the promotion of criminal modern school and social defense school. Socialization of prison execution is the inherent requirement of the theory of penalty humanitarianism, educative punishment, execution economization, deepening reinstatement and restorative justice and now it has become international recognized basic principles of execution.Since the beginning of prison reform movement, Euro-American countries have already started historical process of socialization of prison execution system construction and up to now there have formed execution systems of socialization of prison execution with characteristics of wide varieties and distinctive features. Although our country's work on socialization of prison execution has certain policy and legal basis, our country's level of socialization of prison execution is still quite low, compared with developed prison system countries. There exist some fundamental problems in prison system, such as simple extensive classification of prisons and criminals, weak socialization of criminal education and vulgar understanding of socialization of prison execution, etc. After exploring the reason, we may find that the key point lies in that our country's socialization of prison execution is faced with puzzles of deep-seated problems, such as alienated prison function, lagging legislation of socialization of prison execution and prison execution's lacking of science and democracy.According to the above analysis, the paper puts forward several suggestions from the standpoint of our country's socialization of prison execution system construction:One is that it suggests we should timely sum up successful experience in classification and ranking of prisons and criminals at home and abroad and we can widely build typology prisons. In terms of alert level, we can divide prisons into several ranks, strengthen work on classification and ranking of criminals and thereby lay the foundation of carrying out progressive system at the event. Two is that we should construct simulated society in prison consisting of the socialization of living environment, reforming through labor and education. In combination with implementation of progressive system at the event, we can let criminals accomplish the process of socialization and resocialization during their gradually restoring personal freedom. Three is that in order to value and protect lawful rights and interests of criminals and strengthen social supervision and constraints on prison execution, we suggest attempting criminal limited autonomy, promoting the open of prison affairs and guiding social forces to supervise prison law enforcement. Four is that we should improve quality evaluation mechanism of criminal reforming by means of perfecting quality evaluation system of the individual criminal transformation, giving full play to quality assessment of criminal reforming in prison and establishing abnormal behavior evaluation mechanism, etc.
