Green Trade Barriers In China's Foreign Trade Law Countermeasures

In recent years, China's export offen suffered from"green trade barriers" . The export products often be embargoed, destroyed or be impositioned of high tariffs because they do not meet the importing country's environmental standards,technology standards, packaging labelling standards, lacking relevant certification . This has brought serious implications to China's foreign trade. If our country can not deal with this green trade barriers seriously, can not cross this "green trade" threshold, our country will lose the wider international market, economic development will be out of the question.The paper tried to give a more comprehensive definition to green trade barriers through in-depth study of the dual nature of green trade barriers, point out that we should objectively look at the impact that the green protection take to China's, and actively take advantage of this opportunity to development our country's green trade. Since the green trade barriers we faced , this paper put forward countermeasures from a legal point of view : On the international, we should strengthen the international cooperation, learning the WTO regulations and the relevant provisions of the developed countries, participate in international negotiations, and make full use of preferential policies for developing countries, make use of the WTO dispute settlement mechanism; Domestically, we should improve and perfect our country's environmental regulations that relevant with the trade, as well as the system of green production, improving product technology, green content, and stop the use of energy-consuming equipment that pollut the environment,encourage clean production, use the international standards, establish green packaging system, green signs system, environmental subsidies, environmental tax system in order to meet the international market demand.From another point of view, we should regain the initiative, fix the product's environmental standards in the form of law ,increase the authority, take corresponding requirements to the imported products, and we should establish and improve our country's green protection system according to the WTO, international agreements, international reference standards, common practice in developed countries.
