Study On The Legal Countermeasures Of Constructing Our Green Trade Barrier

The sustainable development idea has a deep impression to the world. As far as foreign trade concerned, it should make trade and environment coordinating development, to boost circulating economic and achieve "win-win" purpose between trade and environment. Facing the serious environmental problem in foreign trade, we should make use of international law and experiences of other countries to construct our Green Trade Barrier. This thesis was divided into the preface , 5 chapters and conclusion, it includes 6 ten thousand words.The value of research was mainly released in thesis's preface. As one of three biggest importing countries, it is necessary to prevent pollution from importing. Green Trade Barrier can solve this problem. However, the research in this field is superficial, for this reason this thesis has the fulfillment meaning and the theories meaning.Chapter I states the theory foundation of Green Trade Barrier. What's more, its theory basis is anatomized through law, economic and sociology. These not only provide next context good basis, but also deep master degree thesis studying with practice meaning and the theories meaning.Chapter II is from the point of view of international law. It states the trade-related international environment convention and WTO, especially the Environmental Exclusion Clause in the GATT. These make us have the exact meanings to be applied in our Green Trade Barrier.Chapter III is from the point of view of national law on how to supervise environment. It mainly states environmental label system, green revenue and green custom system , green pack system, the environment-related trade measures. Thesis applied international law to analyze these systems. So, we can make use of these experiences to construct our Green Trade Barrier.Chapter IV states the necessity of constructing our Green Trade Barrier. For the dilemma between trade and environment, our stratagem of sustainable development is challenged.
