Study Of The Legitimate Rights And Interests Of Migrant Workers

Migrant workers as a new social group is the inevitable result of thedevelopment of China's modernization,industrialization and urbanization. In thepresent policy institution, migrant workers optimized the labor resources anddistribution of productive forces between urban and rural areas, creatively connectedthe "three rural" with the modernization,industrialization and urbanization, blazeda path in the coordinated development of urban and rural areas. They created thewealth for the urban, inereased incomes of the rural, and made significantcontribution to deepening the reform,expanding the opening,speeding up theprocess of industrialization and urbanization of China.However, in the extant dual social structure, migrant worker group is a fringeand vulnerable group. To their fringe, migrant worker is a bilateral fringe group.There is great difference in the social status between the migrant worker and thesheer farmer, even the household registration make them have the same name; at thetime, the migrant worker work in the city, but they could not became the trueindustrial worker. To their vulnerable, even there are a huge number of them, but thedefects of the system and the lower of their own qualities make the migrant workerout of the system and lose the rights to speak for themselves. Lacking of thecapability to stand up for themselves by their own force, they became the vulnerablegroup passively which has huge numbers in the keen competition of the marketeconomy.Migrant workers had become the major force of building socialist harmonysociety, ignoring or defying their legitimate rights and interests deprived their basicinterest as a legal citizen and also violate a treaty of the human rights. In the presentcircumstances of building socialist harmony society, solving the problem of themigrant worker's legitimate rights and interests rapidly is the tie of the coordinateddevelopment of the urban and rural areas, protecting the migrant worker's legitimate rights and interests effectively is the important part of the harmony development ofthe human rights, and achieving the migrant worker's legitimate rights and interestsfully is the important base of building socialist harmony society. I start this articlefrom the point of view of the human rights, according to the constitution, connectingthe fact and the theory, systematically discussing the development,the fact and themain reason of the violation of the migrant worker's legitimate rights and interests,and the main countermeasures and notices to solving the problem of migrantworker's legitimate rights and interests, is to call for society to protect the migrantworker's legitimate rights and interests automatically, voluntarily and willingly, andexpected migrant worker's consciousness of legitimate rights and interests awaken,solved the problem completely to make the social fairness,justness and harmonycome true.
