| Constructing socialist harmonious society is a complicated and systematic project. Accomplishing this goal needs various ways and measures, including democracy, rule by law, economy development and moral education, among them, rule by law is irreplaceable. Socialist harmonious society is a harmonious system consisting of person and person, person and society, people and nature, the mechanism of legal regulation of constructing harmonious society is just to build, maintain and promote the harmonious relationship between person and person, person and society, people and nature with putting people first.Harmonious relationship between person and person is the base of a harmonious society, and fairness and justice is the basic element of people's relationship. The mechanism of legal regulation of constructing harmonious inter-persons relationship is established in the fair personal benefits to balance the social interests. Currently, the disharmonious legal factors of inter-persons relationship mainly are social discrimination resulted from legal system difference treatment, harsh inter-persons relationship owing to social dishonesty, human rights abuses because of lacking of human legal operation and wrong legal administration according to out-of-date laws. So, the following measures should be adopted to harmonize the inter-persons relationship: firstly, the legal mechanism of defining and protecting personal rights and obligations; secondly, the legal mechanism of ensuring social honesty; and thirdly, the legal mechanism of easing conflicts and disputes.The relationship between person and society includes the relationships between person and nation, person and collective, citizen and community, person of some class and person of another class, among these, the most important one is the relation between person and nation. The power of nation originates from persons, its goal is to protect its citizens, so, the laws of a nation should reflect the ideas of its people. At present, the disharmonious legal factors of relationship between person and nation mainly are the rural and urban gap out of dualistic social construction, the poor and rich gap caused by unfair distribution system, conflicts between common people and government officials, mental puzzle owing to values difference, and unsuccessful reference to the foreign laws. Accordingly, to harmonize the relationship between the person and society can begin with these measures: developing the socialist democracy, protecting the disadvantaged people, activating people's ability, improving emergency system, perfecting community legal construction, promoting anti-corruption, strengthening media supervision and enhancing harmonious international community.As for the relationship between people and nature, on one hand, people should be seasoned with the nature, on the other hand, people must agree to the nature law and change it moderately to realize sustainable development. Presently, the disharmonious legal factors of relationship between people and nature are: soil erosion of arable land owing to farmland system, poor environmental protection because of ignoring of environmental policies and regulations, awkward unfavourable situation of environmental laws among laws system. As the environmental law-making can't meet the demands of protecting eco-system, it is advised to do as follows: publicizing the ideas of "Environmental Right", strengthening legal regulation of eco-system protection, establishing the law-making protection of recycling economy, encouraging environmental lawsuits and perfecting eco-relief mechanism.Of course, law is not omnipotent, but socialist harmonious society can't be realized without law system of good order. Socialist rule of law is the base of constructing harmonious society, we should attach importance to its important roles. With the fast implementation of strategy of "Governing the Country by Law", the day of realization of socialist harmonious society is just around the corner. |
