The Improvement Of China's Administrative Assistance System

Since reform and opening up, China's economy is on the trend of prosperousdevelopment, and our living standard has also improved greatly. However, the livingconditions of vulnerable groups have aroused people's concern and the reflection of theacademic circles. In the background of concerning people's livelihood and promotingsocial fairness and justice, the theoretical research of administrative assistance becomesincreasingly important. It will help to build a favorable interaction between thegovernment and the citizens. It is the enrichment and development of the modernadministrative law. It also makes further demands on the government's responsibility andobligation. The improvement of the administrative assistance system can help to ensurethe living standard of people who have difficulty to sustain livings and it also has greatsignificance for the people, the state and the society.This paper studies the concept of administrative assistance as the logical startingpoint, and from the theoretical basis of administrative assistance to explore the meaning ofits existence. The establishment or improvement of administrative assistance system canonly be accomplished upon the understanding of it. Therefore to define the concept ofadministrative assistance is the basis of the paper. The development of our country'sadministrative assistance has made a great progress, but there are some problems inpractice, including the applicant's family financial situation is difficult to verify; thestandard of administrative assistance is low and abstract; administrative assistance lack ofthe necessary hearing system; the exit mechanism of administrative assistance isincomplete; the relief way of administrative assistance is insufficient; the legislation ofadministrative assistance is lower. Through the literature research and comparativeresearch on the administrative assistance of the United States, Britain, Japan and someother countries, and summarizes their features and trends with a view to the developmentof our country's administrative assistance. This paper argues that perfect our country'sadministrative assistance system should regulate the investigation system of applicant'sfamily financial situation, scientific formulate assistance standard, introduce the hearing system of administrative assistance, establish an effective exit mechanism, perfect therelief way of administrative assistance, improve the legislation hierarchy of administrativeassistance.
