Plea Bargaining In Research

Emmerged and developing in the United States , the plea bargaining system has been explanted by many countries of different legal system for its effects in improving the efficiency of proceedings and saving judicial cost. In recent years, under the pressure of giant criminal cases number and the judicature`s inefficiency, many China`s scholars call for the introduction of the plea bargaining system , but the voices of opponents are also prevalent. For a while , we have no idea which way to lead. This paper summarizes the results of previous studies on the plea bargaining system and offers a objective presentation and theoretical analysis. Then , the author makes a thorough demonstration on whether we should introduce plea bargaining into our legal system by analysing the actuality of our criminal judicature. This paper is divided into four parts, respectively on Plea Bargaining System Overview, the conflicts among the p;uralistic values of Plea Bargaining , feasibility analysis on the implementation of the plea bargaining system and the building of the system.
