One of the prevailing issues on the minds of the international community as a whole has been that of international terrorism, which undermines world peace and international security. The United Nations Security Council Resolution 1373 entitled member states the power to strengthen their efforts on counter-terrorism at both domestic and international level. The counter-terrorism measures, however, have adversely affected due process, the rule of law and human rights. This unexpected outcome urges the international community to ponder over how to continue with counter-terrorism globally and at the same time take human rights into consideration.This article looks to analyze the relationship between counter-terrorism and protection of human rights, trying to clarify that human rights are the ultimate goal of counter-terrorism and under no circumstances can be sacrificed illegally. This article goes on to examine in detail particular provisions within several domestic laws relating to counter-terrorism and finds out the reasons behind the unexpected, frustrating side-effect of those national legislations. The only way out is to look for a balance between counter-terrorism and protection human rights. The author comes up with principles which counter-terrorism should comply with and concrete measures states may take reference to. The counter-terrorism campaign should be carried out under United Nations framework and calls for international cooperation.
