However, the openness of the Internet and other features, have made many copyright works of journalism infringed by many traditional media and Internet media commercial and non-commercial, copyright law provides the right to reprint for the news "legal permit" is misinterpreted, it becomes unfair competition legal reasons for some of the traditional media and internet news media. Many internet news violations disrupt the order of the press reports, harming authors' rights. Therefore, starting from the concept of the internet news, the author of this article discusses how to protect the rights of internet news.This paper based on the basic principle disciplines of Copyright Law, is a cross-cutting interdisciplinary research topic between Journalism and Communication, using comparative analysis method, empirical research method and law hermeneutic. Apart from the introduction and conclusion, this article is divided into three chapters.The purpose of this paper is to examine how to protect internet news under the network environment. The author starts from the content and features of internet news. As long as internet news have the original conditions etc. should be under the Copyright Law's protection. Under the new situation, internet news is developing: Electronics News, hyperlinks, as well as blog and podcast.In recent years, after WCT and WPPT, the international intellectual property community reached wide-ranging consensus on the digital technology environment under the copyright and neighboring rights, and recognized the legitimacy of a network of copyright. States on internet news legislation have different levels of development. The media are increasingly industrialized, and the news articles are increasingly commercialized, so it's necessary to protect internet news under the Copyright Law. Copyright infringements of internet news, not only harm the legitimate rights and interests of the authors, but also decreased the competitiveness of the media.The copyright infringement performances of internet news are three ways: Without the author's permission, unauthorized uploaded, downloaded, reprinted his work; without permission to edit transmit the articles online; hyperlinks infringement and Multimedia news of copyright infringement.In these infringements above, network service providers, internet content providers, and internet users should bear corresponding tort liability.Our copyright law also provides nine kinds situation for fair use. In these situations, the works can be used without the consent of Copyright rights and adjacent rights of people, and not being paid. However, the author's name and the source's name should be specified. At the same time, the law does not violate copyright holders enjoy other rights. Then the author starts from electronic version of "New York Times" stopping charges, proposing the market is an important factor measuring news articles, Copyright in the legislation should be balanced between users, disseminators and the author's interests, making the author earn much greater economic benefit.At last, the author proposes some thoughts from technology, self-discipline and legal aspects in the copyright protection. Examining our Copyright Law, it is not clear enough in defining news, the legal permit deprived of the author's disposition of the work, providing a convenient for Plagiarism. General Administration Of Press and Publication, as well as the relevant local departments have issued local laws and regulations, taking measures to strengthen the management of internet news dissemination. Copyright collective management can solve the use of internet news, building a bridge between author's rights and the use of news, it not only can protect the author's legitimate rights and interests, and also make the user of the news legitimate. |
