The Research Of Trial By Media Under The Internet Environment

“Trail by media” is a kind of pre-trial beyond the judicial process, because the media and public opinion have the intention to intervene the judicial subjectively, it may give the judge enormous psychological pressure objectively, and make the judge can not exercise the judicial power with the requirements of professional ethics and codes of conduct of judges,so it bring a series of negative effects to the legal construction, the rule of law and the judicial authority. Especially in the Internet era background,there have been many new phenomenon of " trail by media ", we must give them more attention. Therefore, based on the Internet environment, the study of “trail by media ” have a practical significance in academic legal circles and the news media. Currently, there are different opinions about the “trail by media”.Some people think it interferes with the normal judicial trial and breaks the law; some people think it demonstrates the right of media and public, so it has nothing to do with the law.Therefore, this article evaluates and analyzes the phenomenon of “trail by media” to explore the balance between the freedom of the news and independence of the judiciary, the supervision of the news and the fair jurisdiction.
