Internet Fraud Crime Prevention Research

Internet fraud is extensively a kind of crime which is existed in the online community. Based on its network characteristics, and it is very different from conventional crime. As a kind of cyber-crime, it has a network of common crime, but at the same time as a kind of "fraud" crime, it has a lot of its own characteristics Despite the current Criminal Law and Criminology of the network crime scholars doing a lot of research, and achieved many results, but on the whole, there are some problems as far as the characteristics of the network and the state of the crime in the virtual space. The author have both computer professionals and law education background, the two will be combined analysis from the standpoint of different countermeasures, and a more applied research characteristics. This paper is divided into five parts:The first part is about the phenomenon analysis, characteristics and causes of the crime. Firstly exhibiting the phenomena by enumerating the actualizing means of the crime. And the main crime will be divided into two categories; Secondly focused on the characteristics of network analysis and outlining its development trends; Finally, analysis the causes of crime from all angles.The second part ,the author focuses on the strengthening network monitoring and network security legislation on the prevention and control perspective on the issue. To strengthen network monitoring mainly though the start of governance network environment, and the most important way is the network management service providers monitoring system. Network security legislation can regulate Internet users, give a clear information security standards, enable network order more standardized, make network environment more health and hygiene.PartⅢfocuses on the judicial prevention and control from two aspects: first, strengthening the Computer Forensics. For the detection of the crime in the process of evidence to the problems encountered during the response, as an important part of the judicial control; second, preventing crime by criminal law means. Fully aware of the crime and make full use of existing legal resources to combat criminal networks fraud. In partⅣ, the author discusses the technology control of the crime. At present, the technical development of computer provide a lot of benefit to fraud prevention and control. whether active or passive prevention to guard against, the prevention technology as a long-term effective way is necessary to the prevention and control of the crime.PartⅤfocuse on the perspective of international cooperation on the prevention and control network fraud issues. The first is to strengthen international judicial cooperation. From the extradition, investigation and evidence collection, transfer, as well as criminal jurisdiction on the recognition of foreign criminal judgments on the implementation issues that have been analyzed; The second is to strengthen international cooperation in information security by promoting the development of international information security regulations, the establishment of an information security cooperation mechanism, and other areas of the importance of their implementation.
