The earth is the basis for human survival. With the process of industrialization, however, the earth environment has been greatly damaged. Most countries have realized the importance of environmental protection and began to formulate the related law. Thus, a new branch of international law—international environmental law is created. China also faces the severe environmental problem such as the natural disaster, and man-made pollution, which already affects her economic and social developments. Legalization of environmental protection in China begins late, which has a big gap with the developed countries. The backwardness of environmental protection legislation, the unitarily of the legislative main body, the bureaucratism in the enforcement of environmental law process, and the weak consciousness of environmental legal system among citizens greatly influence China's environmental protection. The essay analyzes the advanced experiences of the developed country in legislation, and proposes the consummation which China should carry on in environmental protection. The first is introducing the environment public welfare lawsuit to the legislation to make the citizen, the legal person and the social group have the right to file the environment charge. The second is introducing the accountability mechanism to the law enforcement, emphasizing the integration of power and responsibility and intensifying supervision over the law enforcement environment. The third is referencing experience from the West to integrate the environmental awareness in the plan of instruction. The essay focuses on perfect China's legal system of environmental protection through referencing advanced experience, which could promote environmental protection work and contribute to the construction of the harmonious society in China.
