On The Light Punishment And The Construction Of Harmonious Society In China

Alleviation is the penalty evolution trends in the world, and is also the core content of the criminal law modernization. Especially in the last 200 years, the penalty-alleviation course of the various countries greatly speeds up. Because of the many differences in social system, economic development level, historical and cultural traditions etc. in various countries, they have respective characteristic in criminal law system, but the intercommunity of humanity's criminal law system will be increasing unceasingly, therefore, the criminal law system of various countries will present one kind of unity on the basis of multiptulity. Not only the global economic integration will directly or indirectly promote the mutual impact and the mutual convergence of the criminal law system, but also the cultural exchanges between the two countries have become closer, which will promote the humanity to manage rough consensus on the rational knowledge of the crime and penalty, and the respect to the humanity and the human rights value. In this article, through introducing the related content of the penalty alleviation, on the basis of analyzing the severe sentence tradition and its'fault in our country, according to the current social development situation of our country, the author demonstrated the important meaning of the penalty alleviation to construct harmonious society in our country, and proposed the concrete plan of implementing the penalty alleviation in the process of constructing harmonious society, and hoped the educational world could give more attention and discussion to the penalty alleviation.This article is divided into five chapters, in the first chapter, the author analyzed the canker of the severe sentence principle to harmonious society through introducing the tradition and the reality performance of our country's severe sentence; In the second chapter, the author briefed the connotation, theory and practice of the light punishment, as well as our country's scholars'narration to the viewpoint of the penalty alleviation; In the third chapter, the author explained the value and the basis of implementing light punishment in our country from the aspect of the present situation of our country's social development; In the fourth chapter, the author explained the significance of the light punishment to construct harmonious social through analyzing the relations between the light punishment and the harmonious society; In the fifth chapter, the author proposed the concrete route to realize the light punishment.
