Until recently, there is no specific statute, which governs the field of sports injury of the athletes during their sports life (hereinafter referred to as sports injury). Nowadays with the development of the sports business, more and more sports injuries arise. When deal with such situations, the recent laws appear as vacancy. As a result, more researches on sports injury and the perfection to the recent legal system become a urgent problem which will influence the steady development of the sports business in our country. As there are few scholars researching on this topic, the author tries to study on this problem on the point of sports insurance.The author defines the term-athlete at the beginning of the chapter one, and then generalizes the classifications and characters of the athletes. The creativity of this chapter is that the author gives a concrete introduction of the classifications of the sports injury. With the specific classifications, the protection to the athletes becomes more efficient. Only their are specific cognition and distinct classifications, can we know exactly the aim of the protection to the sports injury. The aim of this chapter is to define athlete and its characters and classifications exactly in order to let it be the theoretical foundation of the protection to the sports injury. The description of the athlete's risks occupies large parts of this chapter. The reason is that when there are sports risks, there should exist ways to share the risks. In the author's opinion, the way to share risks is to build a system of sports insurance. How to deal with the sports injury and share the sports risks are the main content of this thesis. That is to protect the athletes from the sports injury in the way of sports insurance. The author collects and analyses the legislations on this field and finds that it is not in a good condition.At the beginning of the chapter two, the author firstly expresses his opinion that the best way to protect against the sports injury is to participate in the sports insurance, but the problem is that the system of sports insurance is so weak in our country and it is far behind the development of German, Japanese and American system. Lots of weaknesses exist in the cover of insurance, the conscious to participate in insurance and the design of the sports insurance system. The reasons result to the problems include historical factor, factor of the national mechanism and so on. How to shorten this long distance to the developed countries and catching up with them are the urgent problems, which scholars in the field of law and sports should think about.In chapter three, the author gives the brief introduction of German the insurance system at the beginning and then analyzes the Japanese insurance system concretely. The author makes comparison to China and those countries in order to give inspiration to the way to protect our athletes. At the end of this chapter, the author compares American system with Chinese system and analyzes the referred problems of our systems further. In this chapter, the creativities lie in the historical comparison of China and the USA, the supervising system and the insurance broker. As we know, the USA is one of the most developed countries in insurance field. There are enormous insurance companies in America and the cover rate is very high and people's conscious to participate in insurance are also very common. These are the advantages, which we should learn from. After the system comparison and the theoretical analyses, we can learn a lot from the American system and the author expects that it is useful to the built of our own insurance system and solves the current problems in our society.In the last chapter, combined with the specific situation of our country, the author gives some opinions on the topic of sports injury. The aim is to improve the plight of the sports injury in our country. We can develop the sports business much better in the way of perfecting the sports insurance system.
