Along with the mature digital technique for works and the ways transformation of people's reading, our traditional publishing is facing a shock wave of digitalization. The traditional publishing mode began to transfer, and merging with the network publishing will be the direction. Works digitalization and the rapid development of network publishing deeply influenced the traditional copyright law. Some principles of traditional copyright have been reconstructed in the network. The power expansion of the copyright people aroused the interest unbalance of the other parts inside the network publishing, which caused the law system dilemma of network publishing development.This article probes in different rights and duties about composers (copyright people), publishers (disseminator) and users (consumers). The author thinks that the basic system of traditional copyright law is suitable for network publishing, but as for the powers expansion of copyright people and the change of law concept, that's necessary to rebound the rights and duties of every part of network publishing. When probing in the copyright issues of the network publishing such as network browsing, database protection, duplicate right, issue right, technology protection, copyright restriction, this article compares the international treaties of copyright and the copyright law of USA and European Union, analyzing the current situation and shortage of our copyright protection in network publishing, then giving out the author's opinions and suggestions.This article divides into six parts: Chapter one summarizes the concept and connotation of network publishing; defines the subject and scale of this study. Chapter two introduces the theories of balances in our traditional copyright law, analyzes the current situation and copyright protection issues of our network publishing. Chapter three summarizes our construction of law system and administrative management in network publishing. Chapter four selective analysis the copyright contents and disadvantage of differ parties in our network publishing via the comparative analysis of "Internet Protocol" of WCT, WPPT VS network copyright system of USA and European Union, dissecting the deficiencies in our network works copyright protection, try to narrates the problems and solving methods which extends by traditional copyright to network publishing. Chapter five probes in the use of traditional balance theories in network publishing, as well as the current system arrangement of our network publishing copyright restricted, thinking that legal permission is the development trend with the principles of rational utilization used in network publishing. Chapter six puts forward the thoughts of how to perfect our copyright protection system in network publishing: use the principles of interest balances to improve our design of system, perfect works protection system, unify the administrative department and management criterion, and perfect the works acceptable use and industry management centralizes with copyright collective protection.This article hopes to via the study of copyright conflicts in network publishing, on one hand it can be beneficial for balance the interest of every part and perfect our copyright protection system; on the other hand it may use as a reference of law system for the smoothly transformation and rapid development of traditional publishing.
