Study Of The United Nations Convention Against Transnational Organized Crime Convention

The Treaty of Attacking Transnational Organized Crime of the United Nations is a comprehensive international treaty emphasizing international cooperation to attack transnational organized crimes. This treaty sets a series of uniform standard of criminal conviction and legal system, providing basic rules of international law for the joint operation of attacking organized crime throughout the world.This paper is based on the Treaty of Attacking Transnational Organized Crime of the United Nations, using analysis, comparison, and focuses on analyzing the basic tendency of the development of the transnational organized crime throughout the world and the serious damage of the organized crime in the progress of globalization to explore the key value and practical measures of attacking organized crime. The basic purpose of this paper is to explore, locate and analyze the deep reason of the cooperation to attack organized crimes throughout the world and try to find the key point of establishing efficient system to control the the development of organized criminal group. The further purpose of this paper is to promote China the fulfillment of this treaty to consummate the internal legislation and establish long-term system to attack, control and prevent the organized crime.In the term of method, the research of organized crime includes jurisprudence, sociology, economics, politics, statics, criminology and criminal law; in the term of research method, analyzing organized crime needs to surround the spirit and principles of the Treaty of Attacking Transnational Organized Crime of the United Nations and match the internal legislation with the principles of the treaty in perspectives of imputation system, principle and systems of control and prevention to find and testify the problems and conflicts with the attitude of solving practical problems. This paper hereby would make the current legal system and criminal policy of China the beginning of research, focusing on the measures of controlling organized crimes, rating system and forecast system. 1. The main form of the organized crimes in the globalization and sociology, and the principles for the tendency of development in globalization and the prevention of organized crimes of the Treaty of Attacking Transnational Organized Crime of the United Nations;2. In the term of economics, the damage to the normal order of development brought by the organized crime and the important influence to global economy of the organized crimes;3. In the term of jurisprudence, the uniformity of elements of crime alteration and standard of recognition of organized crimes and the relevant principles of United Nations;4. In the term of criminal policy, the key measures of controlling and attacking organized crimes and the key value of attacking organized crimes of the United Nations;5. In the term of the principles of criminal law, the advancement and operation of the system designed by the treaty;6. As for organized crimes, the United Nations puts forward concrete measures to cope and the key basis of operation;7. In the term of statistics, this paper estimate the pluses and minuses of the anti-mafia campaign of China and the distinction with the principle of the treaty;8. On the basis of summary and analysis, this paper puts forward the advices of policies and systems on how to control, attack and prevent the organized crimes;This paper is based on the classic theories of criminology, tries to utilize the insight of the ancient wise and analyze the problems of organized crimes in the status of globalization to make some suggestions and advices on the anti-mafia campaign of China.
