Study Of Agricultural Administrative Law Enforcement System

Agricultural administrative law-enforcement is a concrete embodiment of China's administrative law-enforcement work in the area of agriculture, is an important way for agricultural administrative authority to fulfill its responsibility for agriculture and rural economy management, is a significant content of 'administration according to laws', and is a main safeguard for the process of law-oriented agricultural development and the building of a new socialist countryside. The effective running of agricultural administrative law-enforcement plays an important role in ensuring the safety of food, people's health and properties, protecting farmers' legitimate rights and interests, and promoting healthy development of agriculture and rural economy. The development and perfection of agricultural law-enforcement system is a firm support for continual upgrading and effective functioning of agricultural law-enforcement. As a result, research on the agricultural administrative law-enforcement system has an important theoretical and practical significance to the accelerated establishment of a law-enforcement system with 'clear responsibilities and rights, canonical functioning, effective supervision, powerful guarantee' and a full-time law-enforcement team with 'qualified morality, professional skills, good work style, probity and high efficiency' in order to push forward 'administration according to laws' of the agricultural sectors and speed up the building of a new socialist countryside.This paper uses relevant theory within subjects of administration and administrative laws to analyze the concept and characteristics as well as the framework of agricultural administrative law-enforcement system, to expound its academic basis, and to review its formation and development. By the method of empirical research, the paper points out the problems existed in agricultural administrative law-enforcement system, such as the main body, organization, authority, personnel competence, manner, and supervision of law-enforcement, explains the causes of imperfect agricultural legislation, lagged agricultural administration system reform and lacking law-enforcement fund support. Moreover, the paper introduces and sums up the successful experience and general practice of developed countries and correspondingly gives reference for the construction of amore perfect agricultural administrative law-enforcement system in China. Thus, the paper puts forward five viewpoints to consummate China's agricultural administrative law-enforcement system: Firstly, to consolidate the main status of agricultural administrative law-enforcement authority. Secondly, to accelerate agricultural comprehensive law-enforcement reform. Thirdly, to improve the competence of agricultural administrative law-enforcement personnel. Fourthly, to standardize agricultural administrative law-enforcement actions.
