Legal Aid Quality Assurance System For A Comparative Study

Looking into the legal aid quality control policies of countries around world, we will find that Britain, as the first country that enforce the legal aid, not only has a mature legal aid quality control policy but also has a sufficient legal aid fund which is main supported by governmental financing aid, therefore the quality of Britain's legal aid is effectively ensured; the American's legal aid is funded by multiple sources and the IOLTA is one of its specialties, a legal aid contract project mode has also been created in America to effectively control the legal aid expenses, optimize the allocation of legal aid resources and ensure the legal aid quality; Canada promote a multiple evaluation mode for legal aid, which worth study.By comparing the legal aid quality control policies of china ,we find the quality of legal aid is the essence and core for enforcement of legal aid .At present, the quality control policy for legal aid of China is immature our quality control policy legal aid fund is not sufficient, the quality of legal aidis not develop,the legal aid contract project mode is not ensure, and that has affect the quality of China's legal aid.By studying and comparing the legal aid quality control policies of other countries, we can realize the real meaning for perfecting the legal aid quality control policy, find out the problems existing in our quality control policy, absorb the good mechanism and ideas of other counties for legal aid quality control. After analyzing and comparing the legal aid quality control policies of other countries, we can find the direction for developing the quality control policy for China's legal aid: first, to perfect the policy for ensuring the legal aid fund; second, to establish the quality control system; third, to try the legal aid contract project mode and finally reach the goal of judicial justice.This article introduces the concept of legal aid, the developing history, concept, structure and meaning of legal aid quality control policy (Chapter I), analyzes the legal aid quality control policies of other counties like UK, USA and Canada (Chapter II), describes the current status of legal aid quality control policy of China and points out the existing problems (Chapter III) and proposes the direction for developing the legal aid quality control policy of China (Chapter IV).
