On The Quality Of Legal Aid In China

Legal aid, designed as a law policy to help any people who are in difficulty in making a living or litigants in some special cases, is becoming mature aboard. With the issue of Legal Aid Regulations, it shows that legal aid is taking on a new stage although some problems still remain to be addressed urgently. However, After the settlement of supply and demand pattern of legal aid, scope of legal aid, the quality of handling cases appeares gradually. According to statistics, the public 's comments on quality of handling cases are not hight. Legal aid system, whether it is up to the goal of ultimately reflects in the quality of legal aid cases. In this sense, the quality of legal aid is the core of the legal aid system. Quality control of legal aid case should be concerned about through the whole legal aid system. In this article, I will draw lessons from foreign experience and domestic practice to make pertinent suggestions on legal aid case quality control system.This article is divided into three parts. Part one is the overview of legal aid case quality control system. In this part, we will discuss the concept of legal aid case quality, the standard of legal aid case quality. Part two analyzes present situation of legal aid case quality control system. This part analyze the problem of present legal aid case quality control system, present measure and existing problems. Part three analyzes the construction of legal aid case quality control system. According to the process of legal aid cases, legal aid case quality control system can be divided into three parts. They are pre-control, control in process and control after the event. Taking into account the cost, I do not think that each of the quality control measures have to use in each case. This involves the priority issues, choice of the control measures. In addition, taking into account the reality of China's national conditions, we should the punitive measures carefully.
