Crimes Committed In The Process Of Transportation Construction

Duty crime(official crime), the severest corruption phenomenon, is regarded as a cancer of the social, economical and political life, making enormous harm to the social justice, destroying the economical development and degrading the political fairness. It not only wavers the base of the political power of the country, weakening the executive capability of the party and the government, influencing the integrity of statesman, trampling democracy, legal system and administration, but also undermines the market economy, obstructing the economical growth and the fair distribution of personal income, blocking economic reforms. More importantly, it leads to deterioration of social atmosphere and moral standards, resulting in the lost of justice and the prevalence of extreme individualism and moral nihilism. Given the high prevalence of duty crime in the transportation construction profession, this paper investigates the causes and properties of duty crime in the transportation construction profession, discussing the corruption deriving links and the forms of corruption, and proposing controlling measures and other preventing methods. The paper is organized as follows: Section one mainly discusses the current situation of duty crime in transportation construction profession in China, including its characteristics and causes. The causes are analyzed from such aspects as human nature, economic management mechanism, and supervision mechanism. Section two explores several links in the transportation construction process which easily produce duty corruptions and explores the specific forms of corruptions. Section three analyzes the weak points in duty criminal legislation in transportation construction profession, and proposes some suggestions for legislation perfection. Section four begins with the features of the transportation construction profession and puts forward some other means to prevent position crime. Finally, the paper ends with a brief introduction of the forms and social harmfulness of'peripheral corruption'.
