Public Security Administrative Enforcement Measures

When Administrative Enforcement Law is enacted, the compulsory administrative measure theory has become the focus of the study. However, a comprehensive study is extremely wanted. Administrative compulsory measures by public security are an important part of. This thesis focuses on the public security's administrative measures, and tries to contribute some suggestions for improvement. In addition to the Introduction, this thesis consists of three chapters.The thesis starts from the conceptions of administrative enforcement, administrative enforcement measures, and public security's administrative compulsory measures. Then, it analyzes the status quo and its defects of public security's administrative compulsory measures. Such defects as the absence of legal basis and effective means in some circumstances, violation of due process, imbalance of fairness and efficiency, and legitimacy of the educational measures are examined. Finally, the thesis suggests more applicable legislation, establishment of principle of legitimacy, proportionality, and efficiency, and restrictions on the procedure.
