Green Trade Barriers On Agricultural Trade In China And Legal Countermeasures

After China's accession to the WTO, the influence to china's export imposed by the green trade barrier become more severe, especially the scale of agricultural products subjecting the green trade barrier was wider than ever before with much more testing items and higher standards. Due to the restriction of the green trade barriers, China is confronted with a higher threshold in its entrance of the agricultural product into the international market, making the agricultural product export suffer great loss. Accordingly, it is a highly pressing concern to break the green trade barriers.Based upon the discussion on the concerned concepts of green trade barrier, this paper symmetrically elaborates the reasons and basic forms, and objectively evaluates the passive influences of green trade barrier on the international trade of agricultural goods, and presents an acute analysis of exterior reason of green trade barrier imposed on agricultural products , viz. the protective trade policy of developed countries and regions in name of ecological environment and human physical protection as well as the interior reason, viz. the quality, safety and hygiene of our national agricultural products still can not reach the international green standard. On that basis, it puts forward countermeasures and suggestions in terms of how to improve the quality, safety and hygiene and how to strive for a favorable international environment for Chinese agricultural products.This paper focus on the types, characteristics, forming reasons of green trade barriers, and conducts a analysis and detailed examination on the its influence imposed on agricultural products, and finally put forwards some countermeasures and proposals from the prospective of law. It is of great significance to enhance the competition of our national agricultural products in international market to cope with the foreign green trade barrier, to build our national green technical standard system, maintain ecological environment, and achieve the balance of both economic and environmental profits.
