Green Trade Barriers, Legal Issues In Agricultural Trade Research

With the globalization of world economy, green trade barrier has become one of the main issues in international trade conflicts and the coordination between environment and agricultural products trade would still be a hot topic. As a big agricultural country and the member of WTO, China has built up a preliminary legal system of green trade barrier in agricultural products trading. But it is still not developed comparing with developed countries. Based on the understanding of theories, analysis of the legal systems of developed countries and realization of defects of current legal system in China, this paper aims at building a developed legal system of green trade barrier in agricultural products trading. And it has great theoretical and practical meanings to the liberalization of Chinese agricultural products trading and development of legal system.The methodologies applied in this paper include comparative method, classification method, empirical analysis and combination of theories and practice, etc. The paper creatively spread the analysis and research from the views of laws and agricultural products trading. Through the case studies of exports to EU, Japan and US, defects of current legal system of green trade barrier in agricultural products trading in China was realized. The conclusion of the study is that China should build early warning system and develop legal supervision system in green trade barrier legal system of agricultural products trading, in 'terms of the new changes of global trading and rules of WTO.There will be 5 chapters to illustrate the objective of this paper.Chapter one introduces the background and significance of this paper. A general view of local and foreign theoretical researches on green trade barrier will be provided.Chapter two focuses on the literature review of green trade barrier in agricultural products trading. From the view of laws and agricultural products trading, this chapter illustrates the concept, characteristics and the source of international law of green trade barrier, and analyzes both positive and negative influence of green trade barrier to agricultural products trading.Based on the introduction and investigation of legal systems in EU, US and Japan, Chapter three summarizes the main characteristics of legal systems of green trade barrier in agricultural products trading in developed countries.Chapter four demonstrates the current legal system of green trade barrier in agricultural products trading in China and points out defects through three cases, live stock and fowl export to European Union, vegetable products export to USA and marine products export to Japan.Chapter five provides two legal correspondences and recommendations of the current legal system of green trade barrier in agricultural products trading in China, building early warning system and developing legal supervision system.The last part summarizes the findings of this paper and significance of green trade barrier legal system in agricultural products trading in China,...
