Problems And Countermeasures Of China's Primary Administrative And Law Enforcement Analysis

The building of government administration in accordance with the law has developed greatly, the administrative law-enforcement work has been strengthened as well, the situation of administrative law-enforcement has been obviously improved, since our country reforming and opening to the outside world. However, China is in the initial stage of socialist market economy, the building of a socialist country under the rule of law will take a long and hard historic process, therefore, quantities of problems still existing in the administrative law-enforcement, which shall not be ignored. Especially the problems in administrative law-enforcement in the grass-roots are prominent, which have caused great concern of the whole society. The people mass have responded intensely on this matter. The administrative law-enforcement constitutes government administration in accordance with the law, and it is also an important link in the rule of law. So, under the current situation, it is very significant for how to correctly grasp and analyze the problems in administrative law-enforcement and reasons happened, and put forward corresponding resolving Countermeasures, to comprehensively implement the rule of law as a fundamental principle and to speed up the building of a socialist country under the rule of law.Taking the problems in the grass-roots as a breaking point, starting from the features of legitimacy of entirety of administrative law-enforcement, this dissertation discussed various issues in the administrative law-enforcement in the grass-roots, mainly including issues in administrative law-enforcement subject, power, basis, personnel, and procedure. Through using comprehensive analysis, various reasons causing the problems are analyzed by citation of facts. These reasons included economic development level restriction, the backward thoughts, the backward administrative legislation, the slow pace of administrative law-enforcement system reform, and the supervision of administrative law enforcement is not competent etc. Based on these, the Countermeasures are put forwarded in five respects on these problems to solve them, that is to speed up the development of the socialist market economy in order to provide appropriate economy basis and solid material security for standardizing the administrative law- enforcement, to change our concepts and raise understanding, to establish an advanced socialist rule of law sense; to strengthen and improve the quality of legislation and administrative law enforcement in order to have a good legal environment; to speed up administrative -law enforcement reform and improve administrative law -enforcement system; to continue to improve and strengthen supervision over administrative law enforcement, starting from the system building.
