There exist a great deal of differences between the modern connotations of"rule by virtue","rule by law"and their relationship and the traditional ones, which is also the issue studied and debated for a long time. At the present primary stage of socialism, if"governing the State by both virtue and law"can be realized and how to realize it are not only an important strategic, prospective and theoretical issue, but also a practical issue needing consistent exploitation and innovation.At the new stage, the verification of this issue influences the harmonious development of the State and society.Governing the State by both virtue and laws is a huge system with complex contents, which consists of basic elements such as concept,institution, conduct and environment. Scholars have already studied such basic elements, so the thesis focuses not on repeating the study on those basic elements, but on a more macro level, that is, why such a thought should be adopted under socialist conditions and how to realize such a thought. This is also an important theoretical and practical problem facing us. The thesis consists of five chapters:Chapter I will analyze the connotations of traditional and modern thought of rule by virtue and by law as well as their differences in order to understand the thought of governing the State by both virtue and law deeply and comprehensively.Chapter II elaborates on the historical evolution of the traditional thought of"governing the State by both virtue and law"systematically. Therefore, the thought of"governing the State by both virtue and law"existing for more than two thousand years in Chinese ancient societies forms the historical and cultural basis for the modern thought.Chapter III explicitly analyzes the emerging,developing, perfecting and upgrading of the modern thought of"governing the State by both virtue and law"in China on the basis of the varied development periods of China.Chapter IV describes the theoretical and practical basis of"governing the State by both virtue and law".The logic homology, consistency of value and the complementation of differentiation between virtue and law provide a theoretical basis for the realization of the thought. Moreover, the market economy, democratic politics and spiritual civilization China is striving for supply a realistic basis for the thought.Chapter V analyzes how to combining the two ways of ruling realistically. "Governing the State by both virtue and law"will not be realized spontaneously.To inplement the thought, law is needed to guarantee"rule by virtue"; virtue is necessary to instructrule"rule by law"; moral and legal consciousness of citizens should be improved continously.
