Wto Dispute Settlement Mechanism For Decisions And Recommendations Enforceable

Whether the Dispute Settlement body of WTO, which as an international organization, can pass a report with enforcement? If yes, then how such enforcement is built. This thesis analyzes the law attribute of WTO rules to induce the"behooving"of enforcement; then analyzes the concrete provisions of WTO rules and DSU to induce the"actuality"of enforcement. A further investigation is about the two sorts of safeguard measures of WTO dispute settlement's enforcement. One sort of measures is review procedure and the surveillance, while the other is compensation and concession. These two sorts of measures, especially concession, are the strong supporters of forceful implementation. Meanwhile it's to be noticed that the existing reasons , both impersonal and subjective ,challenge and limit the enforcement. Some of those problems had been brought forward at the negotiation meeting on amending DSU of Doha round, still no essential progress being made.
