Study Of Administrative Reconsideration Hearing System

The administrative reconsideration, an important component of the hearing system, combining with the culture background, legal tradition and administration practice of Civil Law and Common Law, designs the distinguished and characteristic the contents of the administration reconsideration and embodies the good effects. The administration consideration system was established in 1980s by the administrative regulation, however, this system did not come into force until the Administration Law, lack of the hearing procedure embodying the spirit of justice and fairness ,promulgated in 1999. In the consideration of improvement the current administrative reconsideration system in the government by law, the hearing system should be combined in the administrative reconsideration in order to provide practical support to the implement of administrative reconsideration. The whole design of administrative reconsideration hearing system should be established in the mode of party doctrine under power doctrine, and the contents of this system should develop in the aspect of the application scope of administrative reconsideration, the hearing host, the system of hearing archives and examination procedure.
