The crime of forcing the disabled and juvenile to beg was initially stipulated in The Amendment VI to the Criminal Law of the People's Republic of China. The Subject of this crime is the ordinary while whoever has kinship with Victims under the specific situation can also be subject of offense. The intention of doer of the crime with the purpose of making profits can be direct or indirect, while the objects of this crime are complicated. The dangerous act is gathering the disabled and juvenile for begging with violence or coercion to control three or more persons for certain amount of continual time. The condition of violence or coercion should reach the level that makes the victim do not know to resist, disable to or do not dare to resist. The nature of begging is active and gratuitous while the objects of the crime are the disabled or juvenile under 14 ages. When the object is the infant under 1 age, the condition of violence or coercion is unnecessary. Only if the subject control the infant under 1 age, will he or she constitutes a crime. The object of the crime is complicated. However, the defect of this crime is following: The scope of the object of conduct set forth in article is so narrow, which shall take ordinary citizens as the object while the disabled and juvenile as the special ones of serious circumstances. Besides that the way of act should be Class designated and enumerate the condition to define what the serious circumstances can be more specific.
