China's Property Declaration System: The Perspective Of The Conflict Of Interest

The property declaration system is considered as an incisive sword of anti-corruption. Even 230 years ago, in Sweden, the account affairs of officials were public informed for citizens to supervise. Nowadays more than 100 countries and regions carry out property declaration system. In January 2009, in Xinjiang, the Altai administrator issued"the trial regulation of property declaration system for officials of counties or equivalents", which promoting the trying out of property declaration system in some places and arousing extensive attention. On this occasion, the report of the fourth presidium meeting of the 17th National Congress of the CPC put forward perfecting the institution that avoid interest conflict to point out the heading of anti-corruption work and the found of property declaration system. However, few domestic academicians pay their attention to interest conflict. How to avoid interest conflict is becoming a task for us. This paper took the perspective of interest conflict, analyzed the establishment and improvement of the property declaration system. Based on this, five parts was included.The first part is the introduction .Research object, literature review, research approach, innovation and deficiency, research value was presented.The second part,the theory review of property declaration system. Concepts, principle and main elements are included. The principal principle of property declaration system is to avoid interest conflict. Under the perspective of interest conflict five elements of property declaration system are analyzed, which include who, what, when and range, the institution that responsible for declaration, public informed and privacy protection. This was the framework and bedrock of the following parts.The third part, the status quo of property declaration system is analyzed in Chinese some region. It was reviewed that the experience about the trial property declaration system in China from January to December 2009. The keystone was the ground-breaking achievement on the aspects about who, what and public informed.The fourth part is deficiency of property declaration system in China. From conflicts of interests the deficiency of Chinese property declaration system includes insufficient understanding, disjunction with the moral norms, drawbacks of institution. The fifth part, some considerations about perfecting of the Chinese property declaration system. According to the analysis about Chinese property declaration system, some specific measures to perfect this system were given in this paper, including change ideas, strengthen moral construction and detail the regulation.
