With the deepening of housing reform in recent years, extraordinary real estate development has been achieved in China, however, skyrocketing housing prices are gradually becoming the outstanding problems which make a great impact on the healthy development of the national economy and social life, causing widespread concern around the world. According to the current situation of the real estate market prices in China, the author mainly used economic analysis, comparative analysis, historical analysis, normative analysis and positive analysis to propose that a scientific and rational system of legal regulation of real estate should be built as soon as possible to guarantee that the real estate price is proper to the economic development level, then to ensure the sustained and coordinated development of our real estate industry.Based on economic theories,the basic theory of real estate prices in China were analyzed in the thesis in order to understand the basic economic characteristics of real estate prices and the differences from the normal commodity prices, and the cost and supply-demand analysis of the real estate price components was made according to the economic theory,laying the economic foundation for the whole thesis.On this basis, through the data generalization and positive analysis, the situation and forming reasons of the real estate prices were summarized and the necessity for the regulation of our real estate prices was reached. Then the content was followed by the comparative analysis of several ways for carrying out real estate price controls to work out the necessity of legal regulation and control, and the evaluation of the existing law(policy) system for real estate prices to point out its problems, foreshadowing the complement proposal; Finally, the author combined the institutional change of economics,public choice theory and our current national condition,learning from advanced foreign experience in housing law system, building a set of law system for contructing our real estate prices regulation in order to make a contribution to the rational returning development of our real estate prices and a reference for the making of the relevant laws and regulations.
