A Study On The Credibility Of Judicial Judges

The value of laws lies in protecting social justice, the outcome of laws operation is represented by judicial judgment. Public’s trust and approval on judicial judgment relate to state’s degree of rule of law and social credit. The improvement of judicial judgment public credibility has important meaning to the building of country governed by law and comprehensively pushing the progress of ruling by law, is the important countermeasure to implement strategy of ruling the country by law and one of the important goals of our state’s judicial organs reform. Deeply making theory analysis and research on judicial judgment public credibility to provide theoretical support and countermeasures for comprehensively strengthening People’s Court’s judicial judgment public credibility is a very significant task for our country’s legal construction.We can see from practice, because of the change of social structure, the change of social public opinions and judicial system in the transitional period, our country’s judicial judgment public credibility is insufficient and needs improvement, the study on judicial judgment public credibility has its actual meaning. This essay discusses the nature of judicial judgment from the connotation of judicial judgment public credibility, proposes the existing issues in current judicial judgment, and then brings up the methods to improve judicial judgment public credibility by analyzing the problems. This essay divides into five parts. Part one is the connotation analysis of judicial judgment public credibility, this essay limits judicial organ to people’s court and mainly discusses the meaning of public credibility and the necessity of the emergence of judicial judgment public credibility. Part two is the demonstration on judicial judgment public credibility’s evaluation criteria,including legal criteria and social criteria, analyzing the characteristics, contents and shortcomings of the two criteria.Part three is the proposing of issues, including the lacking of judicial independence,the low persuasion of judicial judgment, the difficulty of judicial judgment execution and judicial corruption, all these issues impede the development of judicial judgment public credibility, the goal of this writing is to solve current issues. Part four is the reason analysis of the lacking of judicial judgment public credibility, including social reason and system reason and judicial operation reason. Social reason is brought by the social structure changes in social transitional period; system reason is caused by judicial hierarchy,administration, utilitarianism and localization; the reasons of judicial operation system are the lacking of judgment system and less qualified judges. Part five proposes the methods toimprove judicial judgment public credibility, including the de-administration of judiciary,defining the relationship between People’s court, party committees and national people’s congress, the publicity of judicial process, the perfection of system of people’s assessors and the improvements of judge quality. And at last this essay gets its conclusion.
