An Empirical Study On The Credibility Elements Of Judgment

The third and fourth plenary session of the party’s eighteen Congress has made a major deployment of new post about comprehensively deepen judicial reform and the implementation of the rule of law, then the whole society to the judicial fairness and justice demand accelerated. It forced judicial organs to analyze and reflect the root causes of the current judicial system which can’t meet the public expectation. While improveing the public credibility of the judiciary, One is the judicial organs to improve the process itself to win public confidence and trust of ability, on the other hand, is the communication between the public, let the public credibility of cognitive judicial organs, resulting trust and respect. No matter where on the one hand, has the inseparable relation with "the referee persuasion" and "the referee intermediary" judgment. Therefore, to improve the credibility of the judgment documents into improving the public credibility of the judiciary is the most effective way. Among the various elements of the judgment documents, "the facts are clear, logical and thorough, comprehensive, accurate, the trial process of ideographic contents public" is directly related to the elements and credibility, But the present situation of these elements in the current judicial practice is not ideal, not only need to change the concept of the establishment and the idea, the most urgent is the need for specific treatment technology has operational on the basis of the empirical analysis. In this paper the author in the court of the work of practice and the accumulation of data analysis, has carried on the empirical analysis of the status quo of adjudicative document credibility factors and existing problems, combined with the theoretical basis and practice of adjudicative document’s production and explore specific technical treatment on improvement of adjudicative document credibility factor were studied in detail.
