As is known, the very precondition for concerning department of the government to provide effective public service is to have sound and accurate functional orientation. And China has set forth a strategic aim as to build a service-oriented government, which makes higher demands for the transformation of administrative function. Against this backdrop, what characteristics does the State Ethnic Affairs Commission, as one of the functional department of State Council, have? What are the problems with its functions? And how to make adjustments accordingly? To further discuss these questions is of great practical significance for the State Ethnic Affairs Commission to enhance its functions, to promote the reform of administrative system in relevant departments and to make innovation of the management patterns concerning ethnic affairs.The theoretical foundation of the thesis is based on home and abroad theories of government functions, especially on the review of the functional and systematical construction of a service-oriented government. Through analyzing the history and status quo of the functions of the State Ethnic Affairs Commission, the author discovers that there is a big gap between the State Ethnic Affairs Commission's functional orientation, its setup, its realization types, effect and the requirement of a service-oriented government's functional system, as well as the public needs people have in ethnic areas. That gap is mainly reflected in the following aspects:the functional boundary is vague; there is much difficulty in the establishment and implementation of ethnic policy; social management and the function of public service is rather feeble; the social management system is pretty old; its ability of enforcement is weak, means simplex and creative ability lacking. The functional adjustment and optimization of the State Ethnic Affairs Commission is influenced and limited by both home and abroad surroundings. It concerns the division of functions and powers and the responsibility adjustment between the State Ethnic Affairs Commission and other departments of the State Council in terms of the management of ethnic affairs. Besides, it also concerns the update of its working system, organizing structure and administrative ideas. Its functional adjustment may be made in the following directions:to further establish its functional boundary; to perfect its social management; to enforce its public service and to strengthen its functional law-enforcement. The essence of this functional adjustment and optimization is the upgrade of governmental capacity. The author also puts forward the following ways to realize that:to establish an overall ethnic policy-making mechanism, enhancing its capacity of making public policy; to strengthen the power of supervision and inspection, enhancing its capacity of implementing ethnic policy; to innovate the supply mechanism of public commodities and service, enhancing its supply capacity accordingly.
