The global development of sports activities have led to the professionalization, commercialization and industrialization of sports. As the main driving force of the holding of sports competition, sports sponsorship plays an irreplaceable role. Being the basic legal document, sports sponsorship contract is an agreement which guaranteeing the establishment of sponsorship relationship between the sponsors and the parties be sponsored. With the growing problems such as the non-performance of obligations and the infringement to the sponsors’rights occurring, the lack of particulars legal items, the obscurities in definition and the failing to provide basic legal in a lawsuit have prevented the sports sponsorship market from developing. By analyzing the relevant legal problems deeply, the author strives to make clear definitions about the sports sponsorship and its legal attribute, and gives suggestions from the prospective of standardizing of sports sponsorship market as well as protecting the sponsor.Divided into four parts, the following contents are studied mainly:1. A brief overview of Sports sponsorship contract. This part studied mainly on the definition and category of sports sponsorship contract, and makes preliminary descriptions about sports sponsorship contract.2. The analysis on the legal attribute of the sports sponsorship contract. Based on the current views and some case precedents, the author makes comments on the legal disputes about the attributes of sports sponsorship contract and tells the the different attributes of sports sponsorship contract when comparing to contract of purchasing, contract is of gift and contract of advertising. Then the viewpoint that sports sponsorship contract is bilateral rewarded contract with the attribute of independence and commitment has been raised.3. The discussion of several problems on sports sponsorship contracts. This part starts with the current legislative situation of sports sponsorship contract in our country, and indicates that the current laws and regulations failed to solve the problems related to sports sponsorship contract. With the analyzing the leading causes of three common problems and a special case about sports sponsorship contract, the author figures out legal relationship in the these situations, and thus lays a legal foundation for seeking reasonable solutions to these problems.4. The reflection and suggestions on legislation of the sports sponsorship.Based on the problems mentioned above as well as the legal background of them, the author summarizes and integrates the current view points of researchers, and makes legislative suggestions on the way to categorizing sports sponsorship contract and on the measures to improving the adjustment terms and setting specific regulations about sports sponsorship contract.
