If we take education into consideration from the students' point of view, it will be clear that the history of education development has been accompanied by the history of students' transition from the fringe to the center of education in the world. There is no exception in our country. But this thesis focuses on: in the present situation where "Quality Education" and "Innovative Education" are advocated vigorously, though it has been recognized that students are learning subjects, there is no doubt that it is a nice lie to say that students are subjects in a place where no corner can't be shined by sun. If each student is ensured to enjoy the "sunshine" and become the real master of learning, the key point lies in students' own awareness. It is very necessary for an educator to let students know their own rights.It is an important symbol of educational democracy to regard students as the subjects of responsibilities and rights in modern education. Since the middle of 20th century, it has been an international common action to protect children's rights which include political rights, educational rights, playing rights, entertaining rights, and so on. In our country, though educational laws have been carried out recently, the laws on subjects of education-students are bits and pieces, and incomplete.The connotations of two core concepts are analyzed at the beginning of this thesis. Based on probing into the evolution of viewpoints about students, theoretic background preparation is made for the nature, content, development of students' rights, according to the existing laws and documents. Meanwhile, some important topics about students' rights are put forward for being further discussed.As for students' learning rights, the thesis points out that the key part should be "students do have the rights of being cared for and respected equally by teachers". The so-called care means that teachers must regard students as human beings growing up who may encounter setbacks and pains. The so-called respect refers to that students are regarded as human beings who can take actions according to their own ideas. Teachers should not only take care of and respect students, but also should do this equally. This means that teachers are not permitted to distribute various chances to some students who would be qualified to just because of their being worthy of more care, and not permitted to restrict other students' freedom for the reason that some students are advantageous than others. These principles can be taken as equal viewpoints of freedom. Therefore, students learning rights could be analyzed from two dimensions: students' equality and students' freedom.The final aim of theoretic probing is for application. As to the problems on students' rights during the process of educating in our country, the thesis gives some suggestions on law protection and aids, and also emphasizes more awaking of students' rights and perfecting of claiming system in this aspect, while students' laws development in the world considered. In this way, students are guaranteed to have their own rights veritably.
