On The Human Rights Responsibility Of Multinational Corporations

Development and expansion of multinational corporations is one of the main drivers of economic globalization, multinational companies worldwide to optimize the allocation of resources as a means to continue to influence and change the global economic and political situation. Is associated with multinational corporations in the production process, the host country environmental pollution, labor exploitation, violation of the host country and other residents of the widespread concern about the violations happened quite frequently, it has been caused by the international community. This article is in this context, the human rights responsibilities of transnational corporations in the process of economic globalization that should be undertaken, to study the legal regulation of transnational corporations human rights responsibilities, human rights issues in China and how to deal with multinational companies responsibility.There are four parts in this paper:In the first part is an introduction to the human rights responsibilities of transnational corporations related content. Human rights responsibilities of transnational corporations interpretation of instructions, as well as for the study of the human rights responsibilities of multinational corporations Discrimination on human rights obligations and human rights disputes.The second part is mainly the responsibility of legal regulation of human rights predicament multinational analysis. This part of international law and domestic law two levels to the plight of human rights responsibilities of transnational corporations to analyze legal regulation, on the one hand, from the level of international law, multinational companies have no qualification about international law, it is difficult to assume as a subject of international law of international responsibility; the other on the one hand, in terms of the level of domestic law, the domestic law of their lack of regulation, the lack of legal regulation in the host mode and home country legal regulation modes have their own performance.The third part is a multinational legal regulation issues of human rights violations were discussed. In the analysis of the international law and domestic law are not sufficient to regulate multinational companies, bring forward by pushing the international legislation to improve domestic legislation channels. In addition, it can also be self-regulation by promoting the use of international multinational soft law.The fourth part of the first human rights responsibilities of transnational corporations present situation in China were analyzed, results certainly achieved, the problems found in practice. Then combined with earlier human rights responsibilities of transnational corporations in China proposed regulation, in line with China’s national conditions countermeasures targeted.
