The problem about the relativity between the ownership structure and the performance of commercial banks has been always heated discussed in financial field from which the scholars are attempting to find the way to construct an ownership structure so as to improve the performance of the commercial banks. The intent of the paper is just to find the dominating ingredients affecting the performance of the commercial banks and to disclose the relationship between these factors and the performance through empirical analysis in order to guide theoretically the commercial banks in China which is in transition to enhance its performance.Based on retrospect and presentation about the conception of ownership structure and performance and the relationship between them in property rights and principle-agent theory respectively, also combined with special requirements to probe into the performance of the commercial banks in transition economy of China, the paper attempts to define ownership and performance appropriately used in context and describes the characteristics of the ownership of the commercial banks in China in three aspects including ownership structure, degree of centralization and negotiability structure.
