Set-up And Perfection Of China Water Quality Trade Regulation System

Water quality trade, as a borrowed economical encouraging environment policy, has been put into practice in some area. It has two functional mechanisms, the market mechanism and supervising mechanism. At the present, many scholars in our country have done a lot of researches and studies on the market mechanism, from different subjects such as law, economics and management, and from different angles including the property of drainage, the allotting of drainage rights, the establishment of first grade market and second grade market; Nevertheless, few of them have made any research on the supervising mechanism. According to the existing data and practice, there are still problems with the supervising mechanism of the water quality trade of China such as the absence of law and regulations to follow, the incompleteness of government supervision, the absence of public participation and so on. This paper is going to raise some idea about how to construct and complete the supervising mechanism of water quality trade of China.This paper, through defining basic conception and explaining relative theories, think that supervision could make up the defection of water quality trade market, and promote the realization of the goal, and further raised the idea that the supervising of water quality trade is made up of government supervision and public participation, while the government supervision acts as the main role. And the main content of the supervising is to promise the normal operation of market and necessary water quality standard, based on which, this paper analysis the status of the supervising of water quality trade of our country, and found that there are problems such as the absence of law and regulation to follow, the unreasonable definition of government supervising function, incompleteness of basic supervision system, and the lack of public participation. America, as the origin the idea, has a lot of experience on the supervision of water quality trade. So through careful review, this paper deems that their complete supervising system, hierarchical supervising organization, complete environment risk precaution system has great use for reference for China.Based on their experience, this paper suggests that China construct and improve the supervising system of the water quality trade. Firstly, relevant laws and regulations need to be made. Secondly, the government supervision should be improved, mainly from the following aspects including definituding the rule of supervision, establishing the basic system of supervision, reasonably allocate the rights of supervision, completing the supervising measure of market, set up precaution measures for environment risks. And thirdly, complete the public participation system to ensure the public's rights to participate, properly.
