Legal Issues On Solar Energy Utilization In China

With the aggravation of the energy crisis and the environmental pollution, development and utilization of renewable energy has become a logical choice in ensuring the world's energy security and promoting sustainable development. Being a developing country, China is facing with double pressure of economic growth and environmental protection, the development of renewable energy sources is in urgent. As a new renewable energy, solar energy has a broad space for development, and has received widespread attention of Governments. To promote the development and utilization of renewable energy, China has introduced a number of laws and regulations and administrative documents related to solar energy. But it is still lack of corresponding legal security system of support, policy support and legal assurance. Therefore, we urgently need a comprehensive analysis and research on the existence legal system and the problems existing in the development and utilization of solar energy.This paper takes the two types utilization of solar energy–solar water heaters and solar photovoltaic power generation, which are most widely used for example. This text makes an intensive study of the problems in the development and utilization of solar energy, introduces the relevant legal system and policy measures in the development and utilization of solar energy in China, and makes specific proposals by learning the legislation experience of some Western countries, such as Japan, the United States, Germany, and so on. This Paper is divided into six parts. The first part chiefly proposed the problems and many problems exist in the utilization of solar energy in China, and then pointed out the necessity. The second section describes the status of development and utilization of solar energy. The third part made an investigation of overseas specific legal systems of solar energy development and utilization. It analysis the advantages and disadvantages of the specific legal systems in The United States, Germany, Britain , Japan and other countries .The fourth part introduces the specific legislation existing in the solar energy. The fifth part summarizes the purpose and main principles in legislation of solar energy. The last part made specific proposals to improve the legal system of solar energy development and utilization .thus it reached a relevant system for the perfect proposal, so that the development and utilization of solar energy can develop healthy and rapidly in the legal environment, thus promoting the process of sustainable development.
