To Study Of The Reform And Improvement Of Community Correction

As a community correctional system, whose emergence and development symbolizes the human society from ignorance of a penalty to thinking of science, from barbarism to civilization, from the death penalty to a sentence of imprisonment and then to the gradual process of non-custodial sentence. Since the 1970s of the 20th century, driven by the international forces around the world, today more and more countries focus on promoting the penalty system reform, expanding the application of non-custodial sentence and promoting the development of community correctional system.Our country has begun the pilot of Community Correction since 2003. On February 25th of 2011, the Nineteenth Session of the Eleventh National People's Congress adopted the "Criminal Law Amendment (8)", which is the first time to write community correction into community correction penal code. It provides new opportunities for the development of community correction. Meanwhile, due to the prolonged severe effects thought and the struggle to strike several times since 1980, with supervision and management in the implementation of non-custodial sentence not being in place, the applicability on the issues such as probation, parole, control and generally temporary execution outside prison, etc. is quite low.The subject status of community correction enforcement is not so clear. It is still a period for the community public to understand, accept and take part in the process of community correction in China. The full implementation of community correction still faces a challenge. How to build community correction standardized operation mechanism and working mechanism is an urgent task. We must learn from domestic and international practical experience and improve the system of community correction progressively according to the national conditions of our country, really give play to the community to rectify and safeguard the social stability, construct the harmonious society, improve the penalty execution system and promotes criminals to return to the society smoothly. Based on the community corrections in the domestic and international development and its characteristics, this article analysis the problems and their causes which the community correctional work is facing. Considering of China's actual conditions, it also puts forward the community correctional system reform and improving the community's response to recommendations in the hope that they will be helpful to the healthy development of the communities. The paper is divided into four parts. The first part mainly describes the background and value significance of the community correctional system. The second part describes the development of community correctional system, the features of several models of foreign community correctional systems. The third part focuses on the development of community correctional system status and the difficulties of the development of community correction and the constraining factors of its development. The fourth part is about the suggestions and countermeasures of the reform and improvement of community correction. It proposes measures from ideological understanding, system construction, operation mechanism and other aspects of team building.
