New Generation of migrant workers refer to the agricultural household population who were born in the 1980s later, more than 16 years of age, and employed in non-agricultural industry in cities. They account for more than 60% in the migrant workers and play an important role in Chinese future economic development and the city construction. However, due to historical, economic, institutional and other aspects of the reason, they work and live in the city but can't integrate into the city well. They dissociate between city and rural place and become peasant in city. New Generation of migrant workers made outstanding contributions for social progress and city development but suffered from all kinds of unreasonable and unfair differential treatment and can't enjoy equal treatment as citizens of the country. The paper deeply studied the performance and the reasons of equal rights deficiency of new generation of migrant workers from the perspective of equality and effective countermeasures to protect the equality of new generation of migrant workers on this basis.The paper consists of three parts in the structure. In the first part, the author introduces the prominent features of the new generation of migrant workers in the level of education, lifestyle, consumer attitudes and awareness of rights and so on, compared with the traditional migrant workers and thinks that they have became a new class. Then the author introduces the development of ideas of equality, the connotation and the features of equal rights and puts an emphasis on the concept and the characteristics of the equal rights of the generation of migrant workers. The author explains that the protection of the equal rights of the new generation of migrant workers means to oppose discrimination and unreasonable differential treatment. The equal rights of the new generation of migrant workers is based on an equal footing in the form of substantive equality. The second part, the author analyzes the performance and the reasons of the equal rights deficiency of the new generation of migrant workers in the employment, the new generation of migrant workers and their children's education, social security, political rights and explains that the deficiency of the concept of social equality, urban and rural dual system structure, imperfection of existing laws and regulations and support measures and the deficiency expression mechanism of interest are the reasons of the deficiency of the equal rights of the new generation of migrant workers. The third part explores the countermeasures to protect the equal rights of. The author proposes that to achieve effective protection of equal rights of the new generation of migrant workers, we must first remove the institutional barriers and give the new generation of migrant workers equal civil rights; Second, we must improve the legal system and strengthen the legal protection of the new generation of migrant workers; Third, we must improve the degree of organization to protect the demand of the interests of the new generation of; Fourth, we must improve their quality and strengthen the awareness of protection rights of the new generation of migrant workers; Fifth, we must enhance the political status and nurture "the new citizen awareness" of the new generation of migrant workers.
