Study On The Causes And Prevention Countermeasures Of Telecommunications-fraud In China

Telecommunications-fraud is a kind of crimes that criminal suspects make up fake facts and identities by using communication tools like mobile phones, fixed-line telephones and Internet or modern e-bank technology to commit non-contact crimes on non-specific targets with the help of the air signal. It has become a both hot and difficult problem which severely endangers social security order and people's property security. This paper starts with the lack of laws and professional regulations on this hot issue and tries to get the basic concept and connation of telecommunications-fraud, on the basis of which the paper analyzes the causes and characteristics of telecommunications-fraud and puts forward the prevention and attack strategy on it. Therefore, the main body of the paper is divided into three parts:The first part mainly analyzes the origin, status quo, basic characteristics and attack bottleneck of telecommunications-fraud.Telecommunications-fraud is a newly developed crime, It is a highly technical and intelligent crime based on VOIP phone and internet information technology by using reasons like winning a prize, purchasing low-price goods and security crisis, etc to trap you into it. It is often done by a group of gangsters whose members are well-organized and well-disciplined and good at counter reconnaissance. They use various approaches which are frequently updated. Telecommunications-fraud, happening very frequently and hard to attack, does great harm to society.The second part mainly discusses causes for telecommunications-fraud from factors like economy, law, criminal, victim, profession supervision and social prevention. The reasons for Telecommunications-fraud are complicated. Telecommunications-fraud is an inevitable type of crime of the radical changing social environment during the social transition period.The third part mainly focuses on the prevention of telecommunications-fraud and attack on it. We should analyze the causes for telecommunications-fraud to prevent it from happening and to attack on it. Strategies like promoting attack and prevention simultaneously should be taken. Promoting information-led, precise strike strategy; setting up a mechanism cooperated by multiple sectors and various types of police on the basis of public security organs; setting up a cross-region cooperation mechanism to deal with telecommunications-fraud cases cooperatively, a"green channel"for information inquiry and a system of judicial process for public security, procuratorate and court of justice to deal with telecommunications-fraud cases; attaching importance to the effect of the cooperation mechanism of public security organs of various counties, districts and even international counterparts on attacking this kind of crime; consolidating judicial policies; insisting on regarding both criminal law and civil law as equally important; the above strategies are used to crack down on telecommunications-fraud.Attacking telecommunications-fraud is a long-term social project, which requires us to improve actively and continuously the prevention and attack system on telecommunications-fraud so as to curb the occurrence of telecommunications-fraud cases and protect people's property.
