Public Warning System Of Food Safety Research

As a new kind of administrative activities, public warning plays an important role in food safety supervision. In the face of the high frequency of food safety accidents and the limitation of traditional regulatory mode, administrative organs can protect the life and health of the social public effectively by releasing public warning, as well as guarantee the government decision-making effectiveness. However, there are a lot of problems of the actual operation situation of food safety public warning, such as the link of start-up, operation, subsequent relief etc. Therefore, the paper regards food safety public warning as the research object and aims at redesigning and optimizing the system to achieve the purpose of fully developing the superiority of the system. Specifically, the paper is divided into four parts to carry on the discussion:The first part is about problems of the actual operation situation and relevant theories. The event of "Out of limits of Carcinogens in Jinhao Tea Oil", "Tainted Milk Power of Sanlu", "Arsenic in Nongfushanquan" are typical examples of problems of actual operation situation, aiming at indicating the direction of the research. Relevant theories of public warning, such as background, function and constituent elements, lay a theoretical basis for the research.The second part studies the system status of public warning of food safety. There are four links of consumption warning of food safety, which is sampling, inspecting, informing and releasing. Also, there are three links of risk warning of food safety, which is monitoring, assessing and releasing. Risk assessing is the most important part of risk warning food safety, which is highlighted in the paper.The third part studies the problems of the actual operation situation of food safety public warning. There are some problems of consumption warning of food safety, such as "zero participation" of the third party and the lack of administrative responsibility in law of food safety supervision. Also, the problem of risk warning of food safety focuses on risk assess, such as the dependence of risk assessment mechanism and the simplicity of risk assessment model. In addition, the lack of relief is the common problem of food safety public warning.The fourth part studies perfection measures of food safety public warning. It is necessary for consumption warning of food safety to introduce reason system, reconstruct system of the third party, reactivate rights to apply for the re-inspection and make statutory administrative liability. It is also necessary for risk warning of food safety to insure independence and refinement of risk assessment mechanism, regulate the expert selection process strictly and increase the chances of public participation. In addition, the victims in public warning of food safety should have free access to administrative litigation and state compensation.
