Research On Legal Issues Of Information Disclosure Of Food Safety Supervision

In recent years,although China’s food safety environment has been significantly improved,but the public’s confidence in food safety is always weak,the lack of food safety confidence is mainly due to the lack of food safety supervision information disclosure laws.The state has always attached great importance to the issue of information disclosure in food safety supervision.In 2018,the State Market Supervision and Administration implemented the Measures for the Management of Information Disclosure in Food and Drug Safety Supervision,which has taken a solid step in the field of information disclosure in food safety supervision.However,through the study,we found that there are still many legislative,law enforcement and judicial problems in the disclosure of food safety supervision information in China.This paper combs the laws of subject,scope,mode,procedure,supervision and relief of food safety supervision information disclosure,and combines the typical case of "cadmium rice" in Jiujiang to analyze the main legal issues of food safety supervision information disclosure in China,including lack of communication mechanism between subjects,vague standards of confidentiality and discretion.Subsequently,the legal systems of disclosure of food safety regulatory information in the United States,Britain and Japan were analyzed and studied to find out the legal measures that can be used for reference by our system.Finally,some suggestions are put forward to improve the law of food safety supervision information disclosure in China.Firstly,we should strengthen the internal communication mechanism among the subjects of food safety supervision information disclosure.Such as improving its information reporting and communication mechanism,implementing the consultation mechanism of food safety supervision information,adding the internal application information disclosure mechanism,introducing the internal charging mechanism of food safety supervision information,and unifying the information standards of food safety supervision.Second,improve the discretion system of food safety supervision information disclosure and confidentiality.Including establishing the subject,scope,responsibility and relief ways of public and confidential review of food safety supervision information.Third,standardize the way of information disclosure of food safety supervision.For example,we should establish a scientific answering mechanism for the disclosure of food safety supervision information and standardize the channels for the disclosure of food safety supervision information.Fourth,standardize food safety supervision information disclosure supervision and relief system.Such as improving the laws and regulations of public assessment,social assessment,annual report and accountability of food safety supervision information,and establishing the review mechanism of food safety supervision information disclosure committee,I hope it will be helpful to improve the law of food safety supervision information disclosure in China.
