In recent years, the government an country have always emphasized the legislation of education laws. In May of 2007, the State Department published "The Planning Outline of National Education Development in the Eleventh Five-year Period" and stated "we must start the drafting of preschool education laws at the right time". In November of the same year, the Education Ministry again listed preschool education law as the focal point of legislation in the next five years, and clearly put it as one of the top priorities in 2008. On Jul.29th of 2010, "The Planning Outline of National Mid & Long Term Education Reform and Development (2010-2020)" rated preschool education as the No.1 job of development. From what we have learnt around the world, the legislation of preschool education laws is an unstoppable international trend. The western countries have all protected and promoted the development of their preschool education thru legislation.Though P.E. is an important part of the kindergarten education, but there is very few laws governing P.E. for preschoolers. There are relatively complete preschool legislation in the western world, but those regarding P.E. legislations are also lacking. Therefore, in contrast to legislations for other education areas, we need to reinforce the legislation for P.E. in kindergartens and consider it as one of the most important questions in our preschool legislation.In this paper, we start from the field experiences, and adopt various methods like researching archives, interviewing the experts and analyzing by comparison, to study China's current legislation of preschool education. We compare the preschool legislation, children's P.E. rights, teachers'accredition, curriculum buildup and etc. to those of sophisticated countries such as U.S. and Japan, as well as Taiwan who is more similar to us. We reach the conclusion that our country needs to step up the legislation of preschool P.E. which must be consistent and compatible to the overall legislation of people's education system. The laws and regulations must protect children's rights to exercise.
