On The Implening Suject Of Community Correction In China

Eight years have seen the trial of community correction in China, there are many achievements of our theoretical study and practice on the community correction, but the community correction systems in the actual operation also expose some problems. In practice, the responsibilities of various departments are not clear and specific; their working efficiencies are great low; staffs, lacking initiative, cope with the problems inefficiently, and even took the opportunity to"rent-seeking"; community correction inmates sometimes refuse to cooperate, which are , however, closely related to the implementing subject of community correction in China.Currently, there are a lot of limitations of the implementing subject of community correction in China, including inadequate understanding of the implementing subject of community correction, the lack of its main authority and the personnels, and inability of the implementing personnels of community correction. This because constraints of traditional thinking and habits, legislative lagging behind actual needs, the daily diverse workload of the judiciary and the difficulty of the community correction.Therefore, starting from the basic theory of the implementing subject of community correction, this paper makes an analysis on the concept of community correction, analyzes the disputes about the implementing subject of community correction from the perspective of the macroscope and microscope, then makes an analysis on the status of the implementing subject of community correction from other countries and areas, finally proposes some ideas about reconstruction of the implementing subject of community correction in China. They include: first, to update concepts and enhance body awareness; second, to better the legislation of the implementing subject of community correction,and clear its status; third, to improve the ability of the implementing personnels of community correction and strengthen its the personnels; final, to introduce social forces to implement community correction, and encourage pluralistic participation.
